This chapter is a commentary on Principle 1 of the Principles for Responsible Contracts (PRC). The PRC were endorsed by the United Nations Human Rights Council in 2011 alongside the United Nations Guiding Principles on Business and Human Rights. The PRC were drafted because of the potential for investment contracts to act as an instrument through which States and businesses could affect the human rights impacts of businesses. The PRC are to be read alongside the UNGPs and were devised to act as an important tool to address human rights concerns in investor-State contracts.
