Despite the UK’s statutory framework for lawful ab ortion\, women deemed to lack mental capacity may face additional legal an d procedural barriers where access is mediated through capacity-based clin ical and legal decision-making. Focusing on England and Scotland\, the ana lysis adopts a doctrinal and socio-legal lens\, drawing on statute and cas e law to show how reproductive decision-making authority may be transferre d from the woman to courts and clinicians. It argues that when decision-ma king ability operates as a threshold requirement\, autonomy becomes contin gent on a finding of incapacity and vulnerability is framed through the la nguage of deficit and risk\, authorising substituted decision-making as th e default response.
